Taiwan trademark renewal: deadlines, grace period and fees
Quick answer: A Taiwan trademark registration lasts ten years and can be renewed indefinitely, ten years at a time. File the renewal in the six months before expiry; the official fee is NT$4,000 per class. If you miss the date, a six-month grace period follows, but the official fee doubles. If you do not renew within the grace period, the registration lapses.
When is the renewal due?
Ten years from the date the registration was published, which is shown on your registration certificate. The renewal window opens six months before the expiry date.
| Period | What you can do | Official fee per class |
|---|---|---|
| More than 6 months before expiry | Nothing yet; renewal not accepted | — |
| 6 months before expiry to expiry | Renew normally | NT$4,000 |
| Up to 6 months after expiry | Renew late | NT$8,000 |
| More than 6 months after expiry | Registration has lapsed; a new application is needed | New filing fees |
Once a registration lapses, anyone can file an application for the same mark, including you. A new application is examined like any other, so a third party's filing can still be refused or challenged, for example if it conflicts with a well-known mark or was filed in bad faith. But you will have lost your registration date, so do not let it come to that.
What do you need to renew?
Less than you might expect. Renewal is a written request to TIPO with the fee, filed by the owner or its agent, for all or some of the registered goods and services. An owner with no domicile or place of business in Taiwan must file through a qualified Taiwan agent, with a power of attorney that needs no notarisation or legalisation.
Check two things before filing:
- Are the owner's name and address on the register still correct? If the company changed its name or address, or the mark was assigned, record the change. The official fee is NT$500 for each change request and NT$2,000 for each assignment, and both are charged per registration: three registrations mean three fees.
- Is the mark still in use? Renewal does not require proof of use, but a registration that has not been used for three years without a proper reason can be revoked on request. Renewal is a good moment to decide whether every class is still worth keeping.
Who will remind you?
TIPO offers an optional e-mail reminder two months before expiry to owners and agents who sign up for it. Treat it as a courtesy, not a safeguard: the owner remains responsible for the deadline. Many owners lose marks because the person who filed them ten years earlier has moved on and nobody else diarised the date.
We docket every renewal for the clients we act for, and when a client asks us to, we e-mail them 180, 90 and 30 days before expiry with the fee and a power of attorney.
Can you change agent for the renewal?
Yes. You can appoint a new agent for the renewal by signing a new power of attorney. If you are not sure who your current agent of record is, we can check TIPO's register for you.
How much does it cost?
TIPO's renewal fee is NT$4,000 per class, or NT$8,000 in the grace period. Our fixed fee is US$300 per class including the normal official fee; the grace-period surcharge is charged at cost.
